Welcome to Looped! Your privacy is important to us. We are committed to protecting and ensuring the confidentiality of any Personal Information you or your Clinic provides to us. 

This Canadian Privacy Policy (“Privacy Policy”) addresses how SKE Innovations Inc. and its affiliates (“we,” “our,” “Looped”) handles information we gather from third parties including, but not limited to, users of the Looped mobile application (“App”) and users of the Looped Services (“Users”) in Canada. This Privacy Policy describes the ways we collect, use and share Personal Information. This Privacy Policy applies whenever you use the App or use the Services in Canada. 

Please read this Privacy Policy carefully. By using our App, or otherwise providing us with your Personal Information, you are hereby consenting to Looped’s collection, use, disclosure and communication of your Personal Information in accordance with this Privacy Policy. 

If you do not consent to the practices described in this Privacy Policy, you may not continue to use our App.

For the purposes of this Privacy Policy, 

Clinic” means the healthcare clinic that has invited you to use the Looped App.

Personal Information” means any information that relates to you and either identifies you directly or could be used to identify you with other information available. It includes your name, user ID, email address, phone number, mailing address and payment account number.

Services” means Looped’s Canadian educational content delivery, journey tracking, rewards programs, and purchase facilitation services provided through the App to connect clinics with their patients in Canada.

Not Intended for Children 

Looped’s App and Services are not intended for children under the age of 18. We do not knowingly collect data relating to children. If you are under the age of 18, do not use or provide information on this App. If you are aware of information about children provided to Looped, please let us know, and we will take steps to remove the information.

Agreement to Terms by Using this App

Please read this Privacy Policy so that you are aware of how and why we use your Personal Information. When you use this App, you consent to have your personal information collected, used, disclosed and communicated in accordance with this Privacy Policy.

 

This Privacy Policy may change from time to time, as reflected in the revision date above, to reflect changing legal, regulatory or operational requirements. Where required by law, Looped will provide notification of material changes to this Privacy Policy through the App at least thirty (30) business days prior to the change taking effect. Where appropriate, we may also email Users who have opted to receive communications from us notifying them of changes to this Privacy Policy. If we are required by applicable data protection laws to obtain your consent to any material changes to this Privacy Policy, then we will do so before such changes take effect.

 

Your continued use of this App after we make changes constitutes deemed acceptance of these terms.

Third Party Links

This App may contain links to third-party websites, plug-ins and applications. Clicking those links or enabling those connections may allow third parties to collect or share data about you. We do not control these third-party websites, plug-ins and applications and are not responsible for their privacy statements and practices. When you leave our App, we encourage you to read the privacy policy of every App you visit.

How We Collect and Use Your Data

Information Gathered

We may collect, store, use and transfer different kinds of Personal Information about you, as described below:

 

Registration and Billing Information. Your Clinic provides us with your name, phone number, and date of birth when inviting you to use the App. You may provide us with your email address and gender during onboarding, and when applicable, billing information such as your billing address when you purchase certain Services or Clinic services through the App. We may also ask Users for additional Personal Information such as general interests (e.g. energy, wellness). Users can choose not to provide this additional information by not entering it when asked or by contacting us directly through one of the means noted in the introduction above.

Log Data and Activity Tracking: Looped collects certain information automatically from Users of the Services, such as login data, search histories within the App, journey completion data, points earned and rewards redeemed, feedback survey responses, content viewing history, and timestamps (including when you accept this Privacy Policy).

Cookies. We collect certain information automatically using cookies and similar technologies, including information from third parties.

User Data: We store and process User data in the context of providing the Services, which may include device information, app version, operating system, and similar information, as well as any Personal Information inadvertently provided to Looped through use of the Services.

Marketing and Communications: We collect, store, and process information that you provide to us when you communicate with us, including when you email us or call us. We also store and process your preferences for receiving marketing materials from us and your communication preferences.

Other. We also collect and use certain aggregate data, which has been anonymized, such as statistical data regarding the use of our Services, for lawful purposes. For example, we may aggregate data to calculate the percentage of Users accessing specific App features. As noted above, this type of data is not considered “Personal Information” subject to privacy laws because it cannot be used to identify a particular person.

We avoid collecting any of the following sensitive categories of Personal Information about you: information regarding your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, health, genetic or biometric data.

Information Use

We will only use your Personal Information when the law allows us to and as described below:

Providing Looped’s Services and Services Communications. Users of Looped’s Services have a specific relationship with us. User registration information may be used to authenticate your access to the App, display customized content from your Clinic, track your progress through educational journeys, award and manage points, process rewards redemptions, facilitate purchases of Clinic services, and send notifications about your treatments and journeys.

Data Management and Support. Looped stores and processes User content only on behalf of, and as instructed by, its Users or their Clinic. However, User content may be viewed or accessed by Looped for the purpose of resolving a problem or support issue. Users are responsible for maintaining the confidentiality and security of their user registration and password.

Improvements. We also use User Personal Information to help deliver a better experience (for example, by displaying personalized content to you based on your interactions with the App), to diagnose technical problems, to support marketing activities, and so that we may better administer and improve the quality of the App and the Services.

Marketing and Promotion. Looped uses the information listed in the section above to contact Users to further discuss their interest in the App and the Services, or to send Users information regarding Looped or its partners, such as information about new features, promotions and events. Any such communications will be sent in accordance with Users’ marketing preferences and consent choices. We may also notify Users with service-related information concerning the Services or the App to the extent allowed by law and in light of the commercial relationship between us. You may opt out of receiving marketing materials at any time by following the unsubscribe instructions included in each marketing communication.

To Enforce Compliance with Our Policies. Looped may access User Data if necessary to investigate a suspected violation of the Terms of Use and/or Acceptable Use Policy for the Services.

To Maintain Legal or Regulatory Compliance. Our Services are subject to certain laws and regulations which may require us to use your Personal Information. For example, we use your Personal Information to pay our taxes, to fulfill our business obligations, and as otherwise required by law. Without using your Personal Information for such purposes, we could not perform the Services in accordance with our legal and regulatory requirements.

How We Share Your Data

Sharing of Information

Looped will not copy, distribute, or otherwise share any User Personal Information except as set out in this Privacy Policy. Looped may share or communicate Users’ Personal Information in the following ways:

 

  • Your Clinic: We share certain information with the Clinic that invited you to use the App, including journey completion data, points and rewards information, purchase orders for Clinic services, and consultation requests.

  • Credit Card processing: Looped uses third-party service providers (Solidus, Stripe and Affirm) to manage credit card and payment processing. These service providers are not permitted to store, retain, or use billing information except for the sole purpose of payment processing on Looped’s behalf.

  • Third party service providers: Looped may partner with other parties to provide Users with specific services such as authentication services (Stych), cloud hosting (Amazon Web Services), error monitoring, and application management (Vessel Partners). These service providers are subject to confidentiality and security agreements and are required to agree to use the Personal Information of Users for the purpose of providing services, under Looped’s instructions, to keep that information secure, and otherwise to handle Personal Information in the same manner as provided in this Privacy Policy, as required by applicable laws.  

  • Potential acquirers of Looped’s business: If Looped is involved in a merger, acquisition or asset sale (each a “transaction”), some or all of Looped Users’ Personal Information may be disclosed or communicated for the purposes of evaluating or carrying out the transaction. In such a case, the other party will be instructed to handle the Personal Information in the same manner as provided in this Privacy Policy, and Users will be notified to the extent required by applicable laws.

  • Law Enforcement. We may be required in certain circumstances to disclose or communicate Personal Information in response to a lawful request by public authorities, courts, law enforcement, or to comply with national security requirements, or as otherwise required by the applicable data protection law. To the extent allowed by law, we will notify you before a disclosure or communication is made.

  • Consent: We may disclose or communicate Users’ Personal Information with third parties where we have consent to do so, except as otherwise prohibited by law.

Data Location and Data Transfers

Users’ Personal Information may be transferred to and processed in countries outside of Canada. Our third-party service providers and partners may operate around the world. This means that when Looped collects Users’ Personal Information, such information may be processed in any of these countries, and accordingly, may be accessible to courts, law enforcement and national security authorities of those countries. 

Specifically, your phone number will be transferred to the United States and processed in the United States for the limited and narrow purpose of authentication through our service provider, Stytch. Payment information will be processed in the United States by Stripe and Affirm. Technical support may be provided by Vessel Partners from the United States. All other Canadian user data is stored in Amazon Web Services’ Canada Central data centre.

How we Protect and Manage Your Data

Security

Looped uses appropriate administrative, technical, organizational, and physical security measures to protect our Users’ Personal Information against accidental or unlawful destruction, loss, and alteration, and against unauthorized disclosure, communication and access. We use standard industry practices to protect Users’ Personal Information, including firewalls, SSL encryption, limiting storage of financial information to PCI compliant third party providers, system redundancies, and co-location in a 24/7 secured, controlled environment. While we employ reasonable security measures, we cannot ensure or warrant the security of any information you transmit to us over the internet, and you do so at your own risk.

We have procedures in place to address any suspected personal data breach and will notify you and any applicable regulator of a breach as required by law.

 

Data Retention

We retain Personal Information we collect from you where we have an ongoing legitimate business need to do so (for example, to provide you with the Services you have requested, to comply with applicable legal, contractual, tax or accounting requirements, or to defend ourselves from possible legal actions). When we have no ongoing legitimate business need to process your Personal Information, we will destroy it or anonymize it in accordance with applicable laws.

Your Choices to Control Your Data

Your Data Protection Rights

You can exercise any one of the following data protection rights as may be available to you under applicable law by contacting us at support@loopedapp.com or through one of the other methods set forth in the introduction to this Privacy Policy. In certain jurisdictions, we may need to verify your identity before responding to your request. Depending on your jurisdiction, you may have the following data protection rights:

  • The right to access, correct, update or request deletion of the Personal Information we collect about you. This is handled through a manual process internally, as there is no self-service account deletion feature in the App.

  • The right to opt out of marketing communications, even if you have previously consented to receiving them. You may opt out at any time.

  • The right to request a portable copy of your Personal Information.

  • The right to de-indexation, re-indexation or cessation of dissemination of your Personal Information.

  • If we have collected and process your Personal Information with your consent, then you may have the right to withdraw your consent by contacting us through one of the methods below – see the heading “Contact“.

Welcome to Looped! Your privacy is important to us, and we are committed to protecting your personal information. This Privacy Policy (“Policy”) governs your access to, and use of the Looped website portal and application (collectively, the “Services”) provided by SKE Innovations Inc., its healthcare affiliates and professional providers (referred to herein as “Company”, “Us”, “Our” or “We”). This Policy describes the information collected, how we use and share that information, who will have access to the information we collect, and the security measures we offer to protect your information. This Policy applies to information we collect when you access or use our website portal (“Portal”) and application (“App”) (the Portal and App may hereinafter collectively be referred to as the “Platform”), when you use our Services or when you otherwise interact with us.

 

When you create, register or log into an account through the Platform, you are automatically accepting and agreeing to the most-recent version of this Privacy Policy, as well as to the most recent Portal and the App Terms and Conditions.

 

Similarly, by visiting, accessing or using the Platform, you are automatically accepting and agreeing to the most recent version of this Privacy Policy, as well as the Portal’s and the App’s Terms and Conditions, and your continuing visit, access or use of the Portal or the App reaffirms your acceptance and agreement in each instance.

 

Our privacy practices are subject to the applicable laws of the places in which we operate. You will see additional region-specific terms that only apply to customers located in those geographic regions, or as required by applicable laws.

SCOPE

Our Policy applies to the personal information we collect related to our:

  • client portal, including our other websites that display this Policy, and the services available through our App or collectively, the Platform

  • information you provide such as when you email us or sign up for services or submit information through our Platform

  • mobile apps (“Apps”) and social media properties

  • business contacts, communications and other online and offline business interactions

  • services that we provide at your request

CONFIDENTIALITY OF HEALTH INFORMATION

We receive personal information that may constitute Personal Health Information (defined as information Company receives and/or creates about you, personally, relating to your past, present, or future health, treatment, or payment for healthcare services, Company will treat this information as possible “protected health information” under HIPAA (Health Insurance Portability and Accountability Act of 1996) and the HITECH Act (Health Information Technology for Economic and Clinical Health Act. Your health information may also be protected by different state privacy laws and regulations in the States in which we operate. For users of Services in Canada, Company will treat this information as possible “protected health information” under PIPEDA (Personal Information Protection and Electronic Documents Act) and PHIPA (Privacy of Personal Health Information Act). We consider personally identifiable information that is linked or reasonably capable of being linked to a consumer and that a regulated entity uses to identify the past, present or future health status of the consumer to be consumer health information, and it will be safeguarded as such.

When transmitting and using your health information, Company complies with all applicable laws. In situations wherein you have authorized Us to transmit information to you by other means, we comply with HIPAA, HITECH, PIPEDA, PHIPA, and other relevant state laws and regulations by entering into Business Associate Agreements with the treatment providers for which we provide services to ensure that your protected health information is appropriately safeguarded.

USE OF OUR SERVICES

Your access to and use of our Services are subject to certain terms and conditions, which are set forth in our Terms of Service. Terms of Service.

INFORMATION COLLECTED

We may collect information directly, as well as from third parties or automatically related to the use of our Services.

  • Information collected directly
    ​​We collect information you provide, such as your name and email address, when you sign up through our Platform or submit information through our Platform. We may collect additional information such as your name, gender, email and mailing addresses, telephone number, date of birth, payment and bank information provided through the use of our Site, Platform, or when you communicate, engage or otherwise interact with us or the Services.

  • Automatically-collected information
    We use cookies, log files, pixel tags, local storage objects and other tracking technologies to automatically collect information including personal information when users access or use our Sites, Apps, or Platform. Cookies are small files of information that a web server generates and sends to a web browser. Web browsers store the cookies they receive for a predetermined period of time, or for the length of a user's session on a website. They attach the relevant cookies to any future requests the user makes of the web server and help us personalize your experience. In some instances, we may use Cookies for security purposes. For more information about automatically-collected information such as Cookies (See the “Electronic Technologies and Cookies” policy below).

  • Information received from third parties and other sources
    We may collect or receive information about individuals from service providers, and other third parties, such as our clients, representatives and professional advisers, content providers, government authorities, public sources and records, and other third parties. We may combine information collected from you with information about you that we obtain from such third parties and information derived from any other subscription, product or service we provide.

  • De-identified or Aggregate Data
    We may de-identify or aggregate information we have collected through our Services or other means so that the information is not intended to identify you. Our subsequent use and disclosure of de- identified and/or aggregate information is not subject to any restrictions under this Policy, and we may disclose it to others without limitations for any purpose, in accordance with applicable laws and regulations.

HOW WE USE INFORMATION COLLECTED

  • Generally, we use the information collected for the following purposes

  • For the purposes for which you provided the information.

  • Responding to requests or when necessary.
    To respond to your inquiries, fulfill your orders and requests (including processing your payments and/or communicating with you about your purchase), provide you with related customer service and otherwise consider your request.

  • Personalizing content and support
    To tailor content we may send or display to you, including to offer location customization and personalized help and instructions on our Sites and Apps, and to otherwise personalize your experiences.

  • Direct marketing and targeted advertising
    For direct marketing purposes, including to send you news and information about our Services, including mobile notifications, as well as to track and analyze trends and usage in connection with our Services for which you may opt-out of these services.

  • Analytics and improvement
    To better understand how users access and use our Site, App, Platform, and other Services, and for other research and analytical purposes, such as to evaluate and improve our Services and business operations and to develop services and features. We may also conduct surveys and evaluations designed to assess and improve our delivery of Services.

  • Protecting rights and preventing fraud and misuse
    To protect the Sites, Services and our business operations; to prevent and detect fraud, unauthorized activities and access, and other misuse; where we believe necessary to investigate, prevent or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety or legal rights of us or any person or third party, or violations of any of our agreements; and to respond to actual or potential legal claims against us.

  • Complying with legal and ethical obligations and legal process
    In order to respond to legal processes (such as court orders, subpoenas or warrants) or regulator investigations and inquiries, or where otherwise required by law or our legal, regulatory or ethical obligations.

  • Supporting our business operations and business transactions
    Where necessary, for the administration of our general business, accounting, record keeping, audit, compliance and legal functions, as well as to consider and implement various business transactions, such as mergers, acquisitions, and reorganizations.

The Right to Opt Out of Cookies and Sale/Sharing Using Online Tracking Technologies

Our use of online tracking technologies may be considered a “sale” / “sharing” under applicable law. You can opt out of being tracked by these third parties on our Platform by canceling your subscription to our Platform. To opt-out of tracking technologies and cancel your subscription you can go to your Client Settings and Cancel, email us your request at: support@loopedapp.com, mail your written request to us at: SKE Innovations, Inc., PO Box #51, Crystal Lake, IL, 60039.

You may opt out by broadcasting an Opt-Out Preference Signal, such as the Global Privacy Control (GPC) (on the browsers and/or browser extensions that support such a signal). To download and use a browser supporting the GPC browser signal, click here: https://globalprivacycontrol.org/orgs. If you choose to use the GPC signal, you will need to turn it on for each supported browser or browser extension you use.

Categories of personal information disclosed that may be considered “sale” / “sharing”: Basic Identifying Information, Device Information and Other Unique Identifiers, Internet or Other Network Activity, Geolocation Data, and Commercial Data.

 

Categories of third parties to whom personal information was disclosed that may be considered “sale”/ “sharing” include advertisers and marketing partners, data analytics providers, and social media networks. We do target advertising, but we do not sell your personal information. Residents of Canada can control the use of cookies and other online tracking technologies by reconfiguring their browser, but please note that some or all of the features of the Platform may be limited, and that Company does not guarantee, nor is Company responsible for any continued use of cookies or other online tracking in such instance. You can opt out of being tracked by these third parties on our Platform by canceling your subscription to our Platform, which is the only way to guarantee tracking technologies will no longer be in use. The Right to Limit the Use of Sensitive Personal Information As mentioned above, we only collect sensitive personal information, as defined by applicable privacy laws, for the purposes allowed by law or with your consent. We do not collect or process sensitive personal information for the purpose of inferring characteristics about you. Some of the purposes for the collection and processing of sensitive personal information allowed by law include: to perform the services or provide the goods reasonably expected; to prevent, detect, and investigate security incidents; to resist malicious, deceptive fraudulent, or illegal actions directed at the Company and to prosecute those responsible for those actions; to ensure the physical safety of natural persons; for short-term, transient use; to perform services on behalf of the Company; and to verify or maintain the quality or safety of a product or service provided by the Company. Therefore, we do not offer the right to limit the use of sensitive personal information.

The Right to Access, Correct, and Delete Personal Information Depending on your state of residence in the U.S., you may have the right to request access to and receive details about the personal information we maintain about you and how we have processed it, correct inaccuracies, get a copy of, or delete your personal information. You may also have the right to withdraw your consent to our processing of your personal information. If you are a resident of Canada, you have the right to request access to your personal information, to have your personal information rectified if it is inaccurate, incomplete or out of date, and to withdraw your consent to our collection, use, and disclosure of your personal information (including or use or sharing of your personal information for marketing or other secondary purposes by canceling your subscription and use of our Platform. These rights may be limited in some circumstances by applicable law. You may also correct basic information through your Client Profile in the Platform you created or, if applicable, by calling your referring medical affiliate.
Typically, we retain your personal information for the period necessary to fulfill the purposes outlined in this privacy policy, unless a longer retention period is required or permitted by law. Please note that in many situations we must retain all, or a portion, of your personal information to comply with our legal obligations; resolve disputes; enforce our agreements; protect against fraudulent, deceptive, or illegal activity; or for another one of our business purposes.

You may submit a request for a copy of the information collected about you by following the steps outlined in the “Your Rights” section above. Depending on your state of residence, you may request for a copy of the information up to twice per year per customer.

Responding to Requests Once you have submitted your request, we will respond within the time frame permitted by the applicable law. Please note that we may charge a reasonable fee for multiple requests in the same 12-month period, as permitted by law.

Appealing Requests Depending on your state of residence in the U.S., you may be able to appeal our decision to your request regarding your personal information. To do so, please contact us in any of the ways listed in the "Communicating With Us" section of this privacy policy. We respond to all appeal requests as soon as we reasonably can, and no later than legally required. If you are a resident of Canada, you may have the right to complain to a privacy commissioner about our decision with respect to your request.

Identity Verification For us to process some requests, we will need to verify your identity to confirm that the request came from you. We may contact you by phone or e-mail to verify your request. Depending on your request, we will ask for information such as your name, an e-mail address or phone number you have used with us.

Authorized Agent Depending on your state of residence in the U.S., you may designate an authorized agent to submit a request on your behalf to access or delete your personal information. To do so, you must: (1) provide that authorized agent written and signed permission to submit such request; and (2) verify your own identity directly with us. Please note, we may deny a request from an authorized agent that does not submit proof that they have been authorized by you to act on your behalf.

If you have been designated as an authorized agent to submit a request on behalf of another customer, you must make the appropriate selection when you submit a Request Form.

Managing Communication Preferences You can stop receiving promotional e-mails, text messages or in-app push notifications by canceling your subscription to the Platform, or notifying us of your desire to cancel your subscription through email at: support@loopedapp.com or mail at: SKE Innovations, Inc., PO Box #51, Crystal Lake, IL, 60039.

Right to Non-Discrimination We do not discriminate against customers who exercise any of their rights described in our privacy policy.

Limited Processing of Canadian Data in the United States Our Company is located in the United States but our Platform is used by affiliates and service providers that may be located in Canada, for the benefit and use by Canadian residents. If you are a Canadian resident, your personal health information will always be processed and stored in Canada. Please note that in the initial creation and use of the Platform, your phone number will be transferred to the United States and processed in the United States for the limited and narrow purpose of creating your Platform. Once processed, any number belonging to a Canadian citizen is no longer processed nor stored in the United States.

CHILDREN’S PRIVACY

We provide content on our Platform that is intended for use only by persons eighteen (18) years of age and older. Neither the Site, App or Platform is designed or intended to attract and is not directed to children under 18 years of age. We do not knowingly collect or maintain personally identifiable information from persons under 18 years of age without verifiable parental consent. If we learn that personally identifiable information of persons less than 18 years of age has been collected without verifiable parental consent, then the Company will take the appropriate steps to delete this information. Additionally, our Sites are not intended for or directed to the residents of Colorado, Connecticut, Delaware, Maryland, or New Jersey who are under the age of 18 years. For these states, if we become aware that anyone under the age of 18 has provided us with personal information, we will delete the information from our records.
